Policy Statement on Whistleblowing

ThU.S. Department of Transportation is committed tprotecting current and former Federaemployees and job applicantfrom interference and retaliation when makinprotected disclosuresor "whistleblowing," which includes disclosininfonnati on relted ta violation of lawruleor regulationgross mismanagement; gross wastofunds; abuse oauthorityor a substantiaand specifidanger to publihealth osafety. ThWhistleblower Protection Act o1989, and the expanded protections provided by thWhistleblower ProtectioEnhancement Act of 20(WPEA), protecindividuals whreport Federaagencmisconducfrom retaliation. ThWPEA strengthens protections foFederaemployees whdisclose evidence owaste, fraud, oabuse anmodifies rules on thuse of nondisclosure policies oagreements by government agencies tmake it clear that these agreementdo nooverride employee rights and obligations created by existing statutor Executive Order relatintclassifieinformationcommunicationwith Congress, or to reportinviolations and/or misconduct to an Inspector General or another whistleblower protection. In additionPresidential Policy Directiv19 extends whistleblower protectionto Federaemployees eligiblfor access tclassified data.

ThDepartment will initiate appropriate actions against responsiblpersons who take, threaten ttake, or fail ttake a personneactiowith respect to any employee oapplicant because of any protected disclosure of infonnation. In 2002, the Notificatioand Federal Employee Antidiscriminatioand Retaliation Act (No FEAAct) was enacted to make all Federal agencies accountable for violations oantidiscriminatioand whistlebloweprotection laws.

ThDepartmenwill notolerate whistleblowereprisal. Legitimate disclosuroinfonnation by employees is an invaluablresource fothe oversight of government operationsexpect that employeeare abltreport these matters confidentialltthDepartment 's Office oflnspectoGenera(OIG)the U.SOffice of SpeciaCounseoappropriatmanagement officials. Those whinterfere with or retaliate againsancurrent oformer employee or joapplicant making a protected disclosure will be subjecto appropriate disciplinary actionIn accordance with the WPEA, a Whistleblower Protection Ombudsmn habeedesignated in 01to educatagency personnel about whistleblower rights.
