FAIR Act Inventory

Federal Activities Inventory Reform (FAIR) Act

The Federal Activities Inventory Reform Act (FAIR), P. L. 105-270, and Office of Management and Budget (OMB) Circular A-76 requires federal agencies to identify the activities performed by their personnel.  Agencies must submit to the Office of Management and Budget (OMB) an inventory of all the activities that an agency performs, inherently governmental activities as well as commercial activities. Each Operating Administration (OA) at DOT is responsible for entering their Fair Act Inventory into OMB MAX Collect by May 30th of each year and submit a Certificate of Completion to the Office of the Senior Procurement Executive (OSPE).

The Office of the Senior Procurement Executive reviews the inventory upload in Max Collect of each OA. Once reviewed the inventory is submitted to OMB. OMB then reviews the inventory and may request additional justification for certain classifications. After the inventory is finalized, OMB places a notice in the Federal Register announcing the availability of the agency's inventory on the agency's web site.
