Terms and Conditions of Access and Use of USDOT Freedom 250 Image Bank

By requesting access to the U.S. Department of Transportation (USDOT) Freedom 250 Image Bank (“Bank”), you agree to adhere to these terms and conditions for access and use, as specified below.

  1. Account Access

    You must provide your valid email address, and any other information requested to complete the approved access process. Your login may only be used by one person - a single login shared by multiple people is not permitted.  Your valid email address is required each time you request access to the Bank.
     
  2. Subject of the Terms

    2.1 Subject to these terms and conditions, you are hereby authorized to access the Bank and are granted a non-exclusive right to download, copy, and publicly display the images (the “Assets”) as made available to you by USDOT, at your own expense.

    2.2 The USDOT seal, trademarks, other logos, and all other intellectual property belonging to USDOT, as well as all intellectual property licensed to USDOT by third parties for use as an Asset within the Bank (collectively, “USDOT and Third-Party IP”) shall remain the sole property of USDOT and such third-party contributors, respectively.  As a Partner of USDOT in the larger Freedom 250 effort, neither you nor any third party shall at any time acquire any right, title, or interest in the USDOT and Third-Party IP.
     
  3. Copyright Law

    You acknowledge that some of the images included in the Assets are subject to the copyright laws of the United States and/or other nations, or other restricted use agreements.  You agree your use of the Assets as authorized under the license granted in subsection 2.1 of this Agreement will comply with both these terms and conditions, as well as all copyright laws of the United States, and you will not modify or share the underlying images with any unauthorized third- party for their use, use the images for any purpose other than the Freedom 250 promotional effort, or use the images beyond the term of the Freedom 250 effort as set forth in Section 6 of this Agreement.
     
  4. No Modification, Resale, or Commercial Use of Assets

    You agree not to reproduce, duplicate, copy, sell, trade, resell, modify, create derivative works, or exploit for any commercial purposes, any of the Assets, including the underlying typefaces, fonts, or images except as authorized under subsection 2.1 of this Agreement.
     
  5. Attributions

    By accessing the Bank and using the Assets, you agree not to alter, amend, or modify the Assets except as herein authorized.  You are authorized to add your company’s brand logo to an Asset.  The inclusion of your brand logo is restricted to the red branding strip at the bottom of each Asset.  Your brand logo must appear immediately to the left of the Freedom 250 and the USDOT logos already appearing in the branding strip.  You may not remove any logos or text from the branding strip.  Your brand logo must be no larger than the logos already included and it may not obscure, interfere with, or overlap the existing logos or the text already included in the branding strip.
     
  6. Refusing Access

    To protect the integrity of the Bank, USDOT reserves the right in its sole discretion to refuse access to the Bank for any reason.
     
  7. Duration of Authorization to Use

    The Assets within the Bank are provided for the sole purpose of promoting the celebration of America’s 250th birthday, our nation’s semiquincentennial.  As such, the promotional effort will only run through the end of the 2026 calendar year.  You hereby agree to terminate your use of the Assets on December 31, 2026, or as near as possible after that date given reasonable extenuating circumstances, but in no instance, beyond January 31, 2027.
     
  8. Disclaimer

    8.1 The Bank and its Assets are provided on an "as is" and "as available" basis and USDOT makes no warranties or representations, whether express or implied, in relation to the Bank, including but not limited to, implied warranties or conditions of completeness, accuracy, satisfactory quality and fitness for a particular purpose.

    8.2 USDOT makes no warranty that the Bank nor its Assets will meet your requirements or will be uninterrupted, timely, secure, or error-free.
     
  9. Limitation Of Liability

    9.1 You agree that, except for death and personal injury arising from its negligence, USDOT shall not be liable in contract, tort, negligence, statutory duty or otherwise, for any loss or damage whatsoever arising from or in any way connected with your access of the Bank and/or use of the Assets, including, without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary loss (even where USDOT has been advised of the possibility of such loss or damage).

    9.2 You agree to indemnify USDOT, our officers, directors and employees, immediately on demand, against all claims, liability, damages, costs, and expenses, including legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the Assets.
     
  10. Miscellaneous

    10.1 These terms and conditions control the relationship between you and USDOT. They do not create any third-party beneficiary rights.

    10.2 Each of the provisions contained in this Agreement is independent of every other provision, so that if any provision of this Agreement is determined by any court or other competent legal authority to be illegal, invalid and/or unenforceable, such determination will not affect any other provisions of this Agreement, the remainder of which will remain in full force and effect.

    10.3 The parties to this Agreement agree to use their best efforts to resolve any disputes arising out of your access to or use of the Bank and its Assets.  Should resolution prove unachievable, this Agreement will be construed and enforced in accordance with the federal laws of the United States of America. Any action to determine the construction, validity, or performance of this Agreement will be heard before the U.S. District Court for the District of Columbia and you hereby consent to the jurisdiction of such court for all disputes, controversies, and claims and waive any venue or non conveniens arguments.
