Indiana Governor Declares a State of Emergency to Provide Relief from Hours of Service for Intrastate CMV Drivers Transporting Propane

Summary

NOW, THEREFORE, I, Michael R. Pence, BY VIRTUE OF THE AUTHORITY VESTED IN ME AS Governor of the State of Indiana, pursuant to IC 10-14-3-12, do hereby declare that an emergency exists and order that: 

  1. The January 29, 2014 proclamation exempting motor carriers and drivers transporting propane in Indiana is extended until March 15, 2014. Motor carriers and drivers transporting propane in Indiana are exempt during this emergency from regulations limiting their hours of service under 49 CFR 395, incorporated by reference into Indiana statute under LC. 8-2.1-24-18. This exemption is effective from the time of the issuance of this order until March 15, 2014, unless otherwise extended or terminated by order of the Governor.
  2. Nothing contained in this declaration shall be considered as an exemption from any portion of the Motor Carrier Safety Regulations other than those regulating hours of service.
